REGULAR MEETING

MARCH 9, 2005

 

 

The Mayor and Council of the Borough of Pine Beach held a Regular Meeting on Wednesday, March 9, 2005 at 7:30 PM at the Municipal Building, 599 Pennsylvania Ave.

 

            Mayor Corby called the meeting to order and read the STATEMENT OF ADEQUATE NOTICE:

 

            IN COMPLIANCE WITH THE ‘OPEN PUBLIC MEETING LAW’ P.L. 1975 C 231 NOTICE OF THIS MEETING WAS SENT TO THE OCEAN COUNTY OBSERVER AND THE ASBURY PARK PRESS, AND POSTED ON THE BULLETIN BOARDS OF THE PINE BEACH MUNICIPAL BUILDING AND THE PINE BEACH POST OFFICE.  THIS STATEMENT SHALL BECOME A PART OF THE OFFICIAL MINUTES OF THIS MEETING

COMMITTEE REPORTS:

 

Police Report:  During the period from 1/1 to 12/31/04, the Pine Beach police department was dispatched by Ocean County communications for a total of 4,770 calls.  Calls include alarms, 1st aid, motor vehicle accidents, dog calls, domestics, suspicious persons/auto, harassment, etc.  These calls do not reflect telephone calls or walk in complaints.

 

Chief Jones attended a safety meeting with borough department heads.  Areas of concern were of a police officer injured on a motor vehicle stop and certification of fire extinguishers for the year 2005.

 

The junior police academy applications are coming in.  Any sixth grade student in the Pine Beach School is eligible.  Sgt. Sgro attended a class at the Ocean County OEM.  Each officer is to receive a gas mask and the class was on fit testing the masks.

 

Police, municipal court, water and sewer utility, building inspector, public works reports approved as submitted upon a motion made by Mr. Cuneo, seconded by Mr. Budesa.

CALENDAR YEAR 2005 ORDINANCE TO ESTABLISH A CAP BANK (N.J.S.A. 40A:4-45.14)

 

This ordinance will be published in the Ocean County Observer on March 29, 2005 and have a public hearing on April 13 at 7:30 PM.

 

Ordinance 05-04-606 was introduced upon a motion made by Mr. Budesa, seconded by Mr. Sheehan.

Resolution 05-35, Municipal Budget for 2005 was approved upon a motion made by Mr. J. Boyle, seconded by Mr. C. Boyle.

 

Mayor Corby spoke about the difficult budget year, and that the introduced budget does not include state aid.  Last year we received $200,000.00.  Debt obligations are included, along with health benefits and various increases.  The rate will go to 46 cents, with all operations within 2 1/2% cap.

Resolution 05-33, Authorizing a Professional Services Contract with the Lomell Law Firm for special counsel with respect to affordable housing obligations was approved upon a motion made by Mr. J. Boyle, seconded by Mr. C. Boyle

 

Mayor Corby explained that our Council on Affordable Housing certification runs out in October.  In the past, we had a vacant land exemption.  All the COAH rules have changed, and the fair share formula is complicated.  The Land Use Board has reviewed our plan, the planner has been directed to complete the new certification.  Members of this firm have been recognized for their expertise in handling Fair Share issues.  Mr. J. Boyle indicated that Mr. Jedziniak has demonstrated an in-depth knowledge of the law, and Mr. Budesa echoed that Mr. Surenian has an excellent reputation with housing matters.

ORDINANCE 05-02-604

 

BOND ORDINANCE PROVIDING FOR THE RECONSTRUCTION OF PORTIONS OF MONMOUTH AVENUE, WASHINGTON AVENUE, AVON ROAD AND WAYNE AVENUE IN AND BY THE BOROUGH OF PINE BEACH, IN THE COUNTY OF OCEAN, NEW JERSEY, APPROPRIATING $141,000 THEREFOR, INCLUDING $100,000 EXPECTED TO BE RECEIVED AS A NEW JERSEY DEPARTMENT OF TRANSPORTATION GRANT, AND AUTHORIZING THE ISSUANCE OF $41,000 BONDS OR NOTES OF THE BOROUGH TO FINANCE THE COST THEREOF

 

This ordinance was introduced at a Special Meeting January 24, 2005 and was published in the Ocean County Observer on February 11, 2005.  It is posted on the bulletin board of the municipal building and copies are available.

 

Mayor Corby explained that this is another portion of road being improved, and that we are following an outline developed several years ago to gradually improve all our streets.

ORDINANCE 05-03-605

 

BOND ORDINANCE PROVIDING FOR THE ACQUISITION OF A SANITATION VEHICLE FOR AND BY THE BOROUGH OF PINE BEACH, IN THE COUNTY OF OCEAN, NEW JERSEY, AND AUTHORIZING THE ISSUANCE OF $190,000 BONDS OR NOTES OF THE BOROUGH TO FINANCE THE COST THEREOF

            This ordinance was introduced on February 9, 2005 and published in the Ocean County Observer on February 18, 2005.  It is posted on the bulletin board of the municipal building and copies are available.

 

PUBLIC COMMENTS

 

Mr. J. Boyle explained that this our present rear loader truck is past its time, and one is needed for bulk items and leaves.  It will accommodate the large trash cans the Borough has issued to the residents.

 

Mayor Corby explained that every 15 years we get a new truck.  We will also upgrade the robo truck, and the purchase will be publicly bid.

COUNCIL COMMENTS

 

Mr. Cuneo mentioned that youth sports are changing to soccer and baseball seasons.

 

Mrs. O’Brien announced that the rabies clinic is March 19 from 1 – 2 at the Borough Garage.

 

The Pine Beach basketball coaches are playing the Pine Beach and Beachwood police on Sunday.

 

 

 

 

MAYOR’S COMMENTS

 

Mayor Corby attended a fund raise for Jon Kirkleski, who was injured in a bicycle accident, and it was a great event with a huge outpouring of support.  It’s important to live in a community that cares about each other.

 

PUBLIC COMMENTS

 

            Mr. Walters asked about the mobile home park area, which he thought was recently sold.  Mayor Corby stated the tourist court is currently zoned commercial with provisions for affordable housing.  If someone wishes to build a regular house, they would have to go before the Land Use Board and ask for a use variance.

 

There being no further business or public comments, the meeting was adjourned at 8:15 PM upon a motion by Mr. Cuneo and seconded by Mrs. O’Brien.
